Case n. 3 (The possibility of institutionalizing the son to a day care centre for the mentally handicapped)
A mother of a
minor child came without a notice to appear to the Municipal Authority of Jihlava, the Department of Social Care to
ask you about following information.
According
to her notification, her son is 12 years
old, he is mentally handicapped.
She provides him all day care (receiving care
allowance for the 3rd
degree of dependence) except for four
hours in the morning, when the
boy attends Primary special school in Jihlava in Březinova street. Two years ago, she divorced her son’s father, and
based on the judgment of the District Court in Jihlava ref. P 175/2009-48 of 29th
September 2009, which entered into force 3rd July 2006, the minor son
was entrusted to her care and his father was obliged to contribute to his maintenance with
the amount of 2,200 CZK a month. Father
has paid the alimony properly, and has
met the son in the minimum extent – for birthdays and Christmas. After the
divorce, she moved with her son to a
flat 1 + 1, currently she can not
cope with caring for her son, whose state
of health has worsen in the last year. She would need a larger scale of help with the care of her son during
the day. Her mother regularly
visits her at the weekend and helps with the care of her grandson.

Solution:
Mother, as the boy’s guardian has the opportunity to express the interest in institutionalizing
in a day care centre for the mentally disabled. The choice of the facility
is not tied to the place of residence
or the number of applications for
admission. Suitable day care centres can be found, e.g. in the register of social services, which is
publicly available on the Internet. She should primarily focus on contacting Day and Week Care Centre in Jihlava.
Those interested in services of the day care centre for the mentally disabled
have the right to be acquainted with the device and can visit the institution personally.
After expressing the interest for admission to day
care, it is necessary to substantiate the actual
medical findings and (according to the decision of the applicant) the
amount of income. A social worker from day care centre makes an inquiry by the
interested in social service and if
it has spare capacity, they can begin to negotiate the conditions for admission
to the facility.
The contract
includes specification of the participants concluding it – a service provider and a user, a type of services to be provided, to what extent and where,
the amount of payment for the
service, date, when the contract shall enter into force, on what conditions the participants
may withdraw from the contract, if
the contract is concluded for a definite
or indefinite period, and the number of copies to be issued. The conclusion
states when and where it was concluded
and the signatures of the participants.
If there wasn’t
a spare capacity in the day care centre, the woman’s son will be placed on
the waiting list. After vacating a place, the day care centre will realize,
whether the mother is still interested
in providing services to her
son. An actual social survey will be
made and they might begin to negotiate the terms of the contract.
The
applicant for the services is requested
in writing through his/her legal representative one week before the arrival
and is acquainted with the information, which documents have to be brought to the facility (e.g. birth
certificate, health insurance card), and which might be brought (e.g. photos,
TV in the room). Day care centres are fully equipped according to user’s needs.
